Terms & Conditions Your Visit Dorset membership

The following terms and conditions apply to the registration of the Establishment with us and to each annual renewal unless otherwise varied in writing. We may vary the terms on not less than 60 days’ notice to you and subject to your right to cancel the registration.

In these terms and conditions: ‘we’ ‘us’ and ‘our’ refer to Visit Dorset Destination Management Organisation and ‘you’ and ‘your’ refer to the proprietor of the Establishment.  ‘Annual Registration Fee’ means the approved annual charge + VAT. 

‘Entry’ means the details of the Establishment and material provided by you for inclusion on the System including any amendment. ‘System’ means our Enquiry and Destination Management System.

Your registration is accepted subject to our approval of the Entry. Our approval does not constitute an acceptance by us that the Entry is provided in accordance with these terms and conditions nor will it constitute a waiver of our rights.

You warrant that the Entry (and any linked website):

  • complies with all applicable laws, legislation, regulations, codes of practice and is not an infringement of any other person’s rights
  • is legal, truthful, honest and complies with all relevant codes, guidance or regulations
  • content provided and displayed in print or online is the responsibility of the advertiser and should be checked regularly.

Visit Dorset supports both the National Quality Assurance Scheme (operated by the AA for VisitEngland) The AA accreditation scheme, the Quality in Tourism Scheme and the Dorset Approved Visitor Accommodation Scheme (DAVAS) and recommend that accommodation providers adopt one of these schemes. Businesses not currently working with one of these schemes are asked to agree to our Visit Dorset Accommodation Charter to agree to meet the minimum quality standards.

You grant us a world-wide non-exclusive, licence to reproduce and display the Entry (including all contents, trade marks etc.).

You will fully indemnify us against all costs, expenses, damages or liability (including legal costs and awards ordered against us) in respect of any claim made against us arising from the Entry or its publication or as a result of any breach or non-performance of any of the representations, warranties or these terms or implied by law by you.

You agree to pay the Annual Registration Fee in advance at the rate applicable; we will give you not less than 14 days’ notice of any change to the Annual Registration Fee. Membership will auto renew following the completion of the membership promotional period (April - March).

If you breach of any of these terms and conditions and in particular if you do not pay the Annual Registration Fee, we may:
• reject or cancel any Entry and to remove it from the System; and
• terminate your registration immediately

You may terminate your registration at any time by not less than 20 days' notice to us.  No refunds will be made.

We will use reasonable efforts to ensure that the System is available to the public at all times. However, we cannot guarantee that the System will always be available and/or error free. In particular, the System may be unavailable during periods when we are implementing upgrades to or carrying out essential maintenance on the System.

We shall not be liable for any indirect, special or consequential loss or damage arising from any failure of the System, including, but without limitation, any late or incorrect publication, any non-publication or inaccurate reproduction of the Entry, whether caused by our error or negligence or by any other reason.

You agree that we may collect, store, and use information about you and the Establishment for the purpose of the operation of the System.

You may not transfer any of your rights under these terms and conditions to any third party.  Anyone who is not a party to this agreement does not have any right under the Contracts (Right of Third Parties) Act 1999 to enforce any part of this agreement.

Visit Dorset Derstination Management Organisation will use your personal information to provide you with the service which you or someone acting on your behalf has asked us to provide. We will also use your personal details for purposes of crime prevention and crime detection and will, if asked, share it with other public bodies for that purpose.

These terms and conditions shall be interpreted in accordance with the laws of England and Wales.
